In construction, disputes are frequent and can have serious financial and legal consequences. Whether you are a private individual, a developer, a builder or an insurance company, a building second opinion in the Alpes-Maritimes (06), the Var (83) and the Bouches-du-Rhône (13) is a crucial step in defending your interests. Our independent expert practice supports you through construction-damage insurance claims and court-supervised expert assessments.

What is a building second opinion?

A building second opinion is a procedure that allows you to challenge the conclusions of an initial expert assessment, whether amicable (out-of-court) or court-appointed. It is often needed when the insured party considers the expert report incomplete, wrong or an underestimate of the losses. Under construction-damage insurance, the project owner can request a second opinion in order to obtain fairer compensation. In a court-supervised expert assessment, a party requests one to bring a technical, adversarial viewpoint.

Construction-damage insurance: why a second opinion?

The purpose of construction-damage insurance is to pre-finance repairs to defects covered by the ten-year builder’s warranty. However, the expert appointed by the insurer sometimes understates the extent of the damage or proposes inadequate technical solutions. In that case, an independent second opinion makes it possible to:

  • Check that the expert report is consistent with the defects observed.
  • Assess accurately the cost of the repairs required.
  • Identify the parties responsible and the warranties that can be called upon.
  • Negotiate fair compensation with the insurer.

A concrete example: An owner finds significant cracks in the walls of their villa in Nice. The expert for the construction-damage insurer concludes that a simple skim coat is enough. Our second opinion reveals a foundation defect requiring underpinning works, which multiplies the compensation amount by three.

Court-appointed expert assessment: the role of the second-opinion expert

When a dispute goes before the courts, the judge appoints a court expert to inform the decision. The parties may be assisted by a technician of their choice, known as a « technical adviser » or « second-opinion expert ». This professional:

  • Analyses the court expert’s report and points out any contradictions or omissions.
  • Assists the client during the expert assessment (meetings, site visits).
  • Drafts written submissions and technical notes to challenge the conclusions.
  • Puts forward a sound argument to defend the client’s interests.

In départements 06, 83 and 13, our practice responds quickly to any type of defect: cracks, water ingress, poor workmanship, non-compliance and so on.

Why use an independent expert?

Independence is the key to a credible second opinion. Cassini Expertise is not tied to any insurer, builder or developer. It works with complete impartiality, with the sole aim of establishing the technical facts. In addition, our knowledge of local specifics (seismic risk, clay shrink-swell, the Mediterranean climate) allows us to adapt our analyses.

Our areas of intervention

  • Residential buildings: houses, co-ownership (condominium) properties, apartment buildings.
  • Commercial and industrial buildings: business premises, warehouses, offices.
  • Civil engineering structures: car parks, roads, utility networks.
  • Specific defects: cracks, subsidence, water ingress, waterproofing defects, technical non-compliance.

How a second-opinion assignment works

  1. First contact: Analysis of your situation and your documents (contract, expert report, photos).
  2. Site visit: Detailed examination of the defects, surveys, measurements and samples where necessary.
  3. Report writing: A detailed report with conclusions, costings and recommendations.
  4. Support: Assistance at expert assessment meetings, in negotiations with the insurer or in court proceedings.
