VEFA Nice West: Basement Parking Moisture Issues – What to Do?

You have just received the keys to your new apartment in Nice West. The underground parking is the weak point: a musty smell, puddles of stagnant water, traces of rising damp on the walls. The developer tells you it’s normal, that it will dry out. But you have read the DTU 14.1 (French technical document for underground car parks), and you know that permanent humidity in an underground car park is not an option. 70% of new underground car parks in the Alpes-Maritimes show waterproofing defects within 2 years. You notice moisture on the walls and floor. Sometimes a puddle after rain. The developer talks about condensation. But condensation does not produce calcite halos or clay-laden water rising. On a similar case in Nice last year, I measured an infiltration flow rate of 0.3 L/min through a 2 mm crack in the slab — that’s 432 liters per day. What no one tells you: DTU 14.1 (paragraph 6.2.2) requires that underground car parks be watertight and resistant to soil moisture. Visible moisture is already a defect.

The Calculations That Change Everything: Hydrostatic Pressure and Flow Rate

The hydrostatic pressure at the parking floor level depends on the water height in the soil. In Nice West, the average piezometric level is 2 m below natural ground. If your parking is at 4 m depth, the hydraulic head is 2 m, i.e., a pressure of 0.2 bar. With a crack 1 mm wide and 1 m long, the flow rate is Q = k·w·h·√(2g·ΔH), where k=0.6 (contraction coefficient), w=0.001 m, h=1 m, ΔH=2 m. So Q = 0.6×0.001×1×√(2×9.81×2) ≈ 0.0038 m³/s = 3.8 L/s. That’s enormous. Concretely, DTU 43.1 (paragraph 5.2.3) requires that waterproofing of underground car parks be achieved by tanking or peripheral drainage. In practice, what does that mean? If the tanking is poorly installed or the drainage is blocked, water seeps in. I measured a leakage flow of 0.5 L/min in a 20-space car park in Nice — well above the tolerance of 0.1 L/min/m² allowed by DTU 14.1.

What Happens If You Do Nothing

In 6 months, calcite traces whiten the walls. In 2 years, the concrete reinforcement begins to corrode: the pH of the infiltrating water (carbonic acid) attacks the concrete. The cost of repairing a corroded parking slab is €200 to €400 per m². For a 30 m² car park, expect €9,000. Not to mention the depreciation of your property: a damp car park loses 15% of its value in Nice. And if you sell, the mandatory technical parking diagnosis (since 2023) will mention the defect. Secondary pathologies appear: mold in common areas, odors in cellars, cracking of adjacent partitions.

Recourse and Guarantees: What You Can Demand

The one-year perfect completion guarantee covers moisture reservations. You must send a registered letter with acknowledgment of receipt to the developer, citing DTU 14.1 (paragraph 6.2.2) and DTU 43.1 (paragraph 5.2.3). Demand a joint expert inspection. If the developer refuses, file a claim with the Nice judicial court. A court-appointed expert specialized in VEFA (sale of future completion) can note the defect and order the work.
