You have just taken possession of your new apartment in Nice, in the Libération district. The developer hands you the keys with a smile. You compare the VEFA plan (pre-sale plan) with reality: the living room seems narrower. You take out your laser measure: 3.88 m instead of the announced 4.00 m. That’s a 12 cm discrepancy. In a room of 20 m², that’s significant. And it may only be the beginning.
What You See – and What It Really Hides

The wall is straight, the paint fresh. Yet the measurement doesn’t match. You remeasure three times. Same result. You look at the plan: scale 1/50, dimension 4.00 m. You measure on the plan with a ruler: 8 cm, which is 4 m at scale. The plan is correct, but the delivered apartment is not. Why?
What I often see in such cases: the developer changed the partition layout during construction without updating the VEFA plan. Or the concrete slightly shifted, and formwork tolerances accumulated. On a case in Nice last year, I measured an 18 cm discrepancy in the length of a bedroom. The developer invoked the 5% tolerance of the CCH (French Construction and Housing Code). But 18 cm over 4 m is 4.5%, just below. The buyer had to accept. Except that the total surface fell below the 5% threshold? Not always.
The Calculations That Change Everything: Surface and Tolerance
The rule: Article L261-1 of the CCH (French Construction and Housing Code) allows a 5% deviation on the total habitable surface area, unless a more restrictive clause applies. But note: the deviation is calculated on the total surface, not room by room. Formula: ΔS = S_theoretical − S_actual. If S_theoretical = 65 m² and S_actual = 62.5 m², then ΔS = 2.5 m², i.e., 3.85%, below the threshold. But if you accumulate deviations from each room, the total may exceed 5%.
Example for a 3-room apartment in Nice: living room 20 m² (instead of 21), bedroom 1: 12 m² (instead of 12.5), bedroom 2: 10 m² (instead of 10.5), kitchen 8 m² (instead of 8.2). Total theoretical: 52.2 m². Actual: 50 m². That’s a 4.2% deviation. Below 5%, but the developer must still justify. If the deviation exceeds 5%, you can demand a proportional price reduction or even cancel the sale (CCH art. L261-1, para. 2).
What Happens If You Do Nothing
You sign the delivery report without reservations. Six months later, you want to resell. The notary remeasures: the surface differs by more than 5% from the VEFA plan. The buyer withdraws. You lose the sale and must sue the developer, but you have already accepted the property. Complicated.
Another scenario: a partition misalignment may hide a more serious problem: a poorly positioned load-bearing wall, a structural error. In Nice, seismic zone 4, tolerances are strict. A 12 cm deviation can cause unforeseen stresses in the bracing. Repair cost: €5,000 to €15,000. And if the developer goes bankrupt? You are left with the defect.
Recourse and Guarantees: What You Can Demand
You benefit from the conformity guarantee (CCH art. L261-1). Send a registered letter with acknowledgment of receipt to the developer within 30 days of delivery, listing the non-conformities. Attach your photos and measurements. If they refuse, file a claim with the judicial court of Nice. You can also appoint an independent expert, such as Cassini Expertise, for a joint inspection. The standard NF EN ISO 5455 specifies dimension tolerances on plans: at scale 1/50, a dimension may vary by ±0.2 mm, i.e., 1 cm actual. Your 12 cm deviation is therefore well outside tolerance.
