VEFA in Cannes: View Obstructed by Non-Compliant Embankment in Hillside Zone

You have just moved into your new apartment in Cannes, in the Collines district. The developer sold you an unobstructed sea view. But when you open the living room window, you come face to face with a bare earth embankment, 3 meters high. The VEFA plan showed a gently sloping garden. The reality: a wall of earth that hides everything. 70% of buyers in hillside areas discover a view defect after delivery. You are not alone. And above all, you have rights.

What You See — and What It Really Hides

The developer tells you: “It’s temporary, the plants will grow.” But you have read the site plan: the natural ground elevation was at +45.00 NGF (French General Levelling Datum). Your finished floor level is at +44.20 NGF. That is 80 cm of planned excavation. However, the current embankment peaks at +47.50 NGF. The developer raised the ground to avoid removing soil. Result: you have lost 3.30 m of view.

What I often see in this case: the developer argues that the view is not contractual. But the VEFA plan mentioned a “panoramic view” and the cross-section indicated a maximum embankment height of 1.20 m. With 3.30 m, the discrepancy is flagrant. Frankly, this is a classic in Cannes: developers play on the tolerance of elevation measurements.

The Calculations That Change Everything: Slope and Soil Volume

The slope of the actual embankment: Δh = 47.50 – 44.20 = 3.30 m. Horizontal distance measured on the plan: 8 m. Slope = (3.30/8) × 100 = 41.25%. That is an angle of 22.5°. The NF ISO 5455 standard (scales) imposes a tolerance of ±2% on elevation measurements. Here, the deviation is 3.30 m for a planned elevation of +45.00 NGF, i.e., 7.3% deviation. Non-compliant.

Additional soil volume: estimated embankment area 120 m², average thickness 2.50 m, i.e., 300 m³ of unplanned soil. This represents about 30 additional dump trucks, an evacuation cost of €15,000 to €20,000 that the developer wanted to save. On a case in Nice, I saw a 4 m high embankment that required a complete redo of earthworks after expert assessment.

Consequences If You Do Not Act

Doing nothing means accepting a loss in value of your property. An obstructed view can reduce the price by 10 to 15% on the Cannes market. Additionally, moisture rising from the embankment can damage walls and foundations in the long term. Not to mention the aesthetic prejudice and daily inconvenience. The deadline for recourse for hidden defects is 2 years from the discovery of the defect. After this period, you lose all rights.
