EXPERTISE — VEFA CÔTE D’AZUR
You have just taken possession of your villa in Cannes. The plan promised an unobstructed view of the bay. But standing on the terrace, you mainly see the freshly cut earth embankment 3 meters from the sliding glass door. You pull out your laser meter: the height difference between your slab and the top of the embankment exceeds 2.50 m. Yet the site plan indicated flat natural terrain. On a similar case in Cannes last year, I measured a discrepancy of 1.80 m between the plan and reality. This is not just an aesthetic detail: the French Construction Code (CCH L261-1) requires conformity to contractual documents. And the view is one of those subjective elements that developers downplay, until an expert assessment.
What You See – and What It Really Hides

The symptom is clear: the earthworks created a berm that blocks the view. But the problem is often deeper. The project’s cross-section plan showed a gentle slope to the south. However, the grading carried out excavated the villa 2.20 m below natural ground level for foundation stability reasons (swelling clays). Result: a steep 3 m high embankment at the property boundary.
What no one tells you: the VEFA plan does not always represent the actual terrain after earthworks. Elevation data is often omitted or approximate. Frankly, a developer can modify the profile without informing you, as long as the building remains within the permit limits. But the view is not protected by Cannes’ Local Urban Plan (PLU). It is a contractual guarantee. And that is where topographical expertise makes the difference.
The Calculations That Change Everything: Slope and Tolerance
To qualify the non-conformity, we compare the contractual cross-section plan (scale 1/50, NF ISO 5455 standard) to the actual topographical survey. I use a Leica TS total station (precision ±2 mm) and a GNSS RTK in RGF93/Lambert 93. On this case in Cannes, the plan promised a 5% slope (i.e., 2.50 m elevation difference over 50 m). The survey gives an average slope of 18% over the first 20 meters. Formula: slope (%) = (Δh / L) × 100. With Δh = 2.20 m (elevation difference between villa and end of plot) and L = 12 m (horizontal distance), we get 18.3%. The tolerance accepted by case law for a VEFA plan is ±5% relative or 0.20 m in elevation. Here, the deviation is 13.3 percentage points, i.e., 266% of the promised value. Non-conforming.
What Happens If You Do Nothing
At 6 months, the unplanted embankment begins to erode. Runoff water loads your garden with sediment. At 2 years, cracks may appear in the temporary retaining wall. At 5 years, the cost of redoing the earthworks (excavation, removal, regrading) exceeds €15,000. Not to mention the loss in property value: a villa with an obstructed view loses 20 to 30% of its value in Cannes.
Secondary pathologies are common: water stagnation against the facade, capillary rise, degradation of coatings. In a similar case in Antibes, the owner waited 3 years before acting: the retaining wall had tilted 8 cm. The repair cost €28,000.
Recourse and Guarantees: What You Can Demand
The contractual guarantee of conformity (CCH L261-1, paragraph 2) allows you to demand restoration of the promised profile. The NF ISO 5455 standard specifies representation tolerances on plans. Your steps: send a registered letter with acknowledgment of receipt (LRAR) to the developer (Nexity, GA Smart Building, etc.) along with a bailiff’s report and a topographical expert’s report. If refused, file a claim with the Grasse Judicial Court. I advise you not to sign a report lifting reservations without the non-respected sea view in Antibes.

VEFA travaux non conformes délai pour agir?
Vous avez généralement un délai de 10 ans pour agir en garantie décennale, mais pour les vices apparents, vous devez agir rapidement après la livraison. Il est conseillé de faire constater les désordres par un expert et d'envoyer une réclamation dans les plus brefs délais.
