Non-Compliant Ceiling Height in Cannes: Laser Measurement and VEFA Plans

You have just taken handover of your new apartment in Cannes, near Le Suquet. The VEFA plan specified a ceiling height of 2.50 m in the living room. You pull out your laser measure: 2.41 m. A 9 cm gap. The developer tells you it’s within tolerance. But is that really true?

To the naked eye, a 9 cm difference over 2.50 m is barely noticeable. But once you install a custom bookshelf or a pendant light, the problem becomes obvious. What I often find in these cases: the developer adjusted the slab thickness or the floor slope to gain centimetres elsewhere.

This type of case often reveals a ceiling height of 2.38 m instead of the contractual 2.50 m. The VEFA section plan showed a finished height of 2.50 m, but the reality included a 7 cm screed that wasn’t mentioned. The developer had failed to deduct the screed thickness on the plan. The result: a clear-cut non-conformity.

The figures that change everything: tolerance and the NF EN ISO 4463 standard

The NF EN ISO 4463-1 standard sets the measurement tolerances for construction. For a ceiling height, the allowable tolerance is ±5 mm per linear metre, with a maximum of ±15 mm overall. For 2.50 m, the tolerance is therefore: 2.50 × 5 mm = 12.5 mm, i.e. ±1.25 cm. Your 9 cm gap is 7 times over that limit.

In concrete terms, the formula for the maximum tolerable deviation (MTD) under the standard is: MTD = ±(a + b·L), where a = 5 mm, b = 5 mm/m, L = 2.50 m. So MTD = ±(5 + 5×2.5) = ±17.5 mm. Your 90 mm gap is out of tolerance. Article L261-11 of the French Construction and Housing Code (CCH) requires the seller to deliver work that complies with the plans and specifications. A 9 cm gap constitutes a clear defect of conformity.

What happens if you do nothing

Within 6 months, you may only notice the aesthetic issue. But by year 2, fitting a custom kitchen or wardrobe will need to be altered, at an extra cost of €1,500 to €3,000. By year 5, if the developer also skimped on the screed thickness, cracks can appear in the partition walls — a sign of differential settlement.

Frankly, it’s not uncommon to see cases in Cannes where the buyer waited too long. The one-year « parfait achèvement » warranty (perfect completion guarantee) had expired, and the developer refused any remedial work. The Grasse court ruled against the developer, but only after 18 months of proceedings and €5,000 in expert fees.

Remedies and guarantees: what you can demand

You are covered by the conformity guarantee (CCH Article L261-11) and the NF EN ISO 4463-1 standard §5.2.2. The process: send a registered letter with acknowledgment of receipt to the developer, detailing the measured gap and requesting a joint measurement. If they refuse, take the matter to the Grasse court to have a judicial expert appointed. In the meantime, do not sign the reservation clearance report. An independent expert can certify the defect and cost out the remedial work (screed levelling, ceiling rework, etc.). In Cannes, expert assessments typically take 3 to 6 months. Don’t delay.
