You open the door of your new apartment in Antibes, near the train station. The VEFA plan (contract for sale of a future completion unit) promised the kitchen on the right upon entry, the living room at the back. You compare the VEFA plan and your apartment. The dimensions seem identical, but everything is inverted. The developer tells you: “the surfaces are the same, it’s not a defect.” Frankly, that’s false.
What no one says: the VEFA plan is part of the sales contract. Article 1604 of the French Civil Code requires delivery in conformity. A mirror inversion changes the interior layout, which can affect the use of rooms (exposure, noise, view). This is not an aesthetic defect; it is a contractual non-conformity. The developer must rectify at their own expense or compensate you.
What Happens If You Do Nothing
You sign the delivery report without reservations. Six months later, you want to resell. The notary compares the VEFA plan and the apartment: they detect the inversion. The sale is blocked, or the price drops by 10 to 15%. On a property worth €400,000 in Antibes, the loss can reach €60,000.
After two years, you have accepted the premises. The developer invokes the statute of limitations for non-conformity claims (5 years from delivery, but harder to prove after acceptance without reservations). Recourse becomes complex. It is better to act at delivery, by refusing to sign the report if the defect is visible, or by issuing a written reservation.
Recourse and Guarantees: What You Can Demand
The guarantee of conformity under Article 1604 of the Civil Code allows you to demand rectification or damages. In VEFA, Article L261-11 of the French Construction and Housing Code (CCH) specifies that the seller must deliver a building conforming to the plans and specifications. Send a registered letter with acknowledgment of receipt to the developer (e.g., Nexity, BNP Real Estate, GA Smart Building) detailing the deviation. If no response within 30 days, file a claim with the Grasse judicial court (Tribunal Judiciaire de Grasse).
