You’ve just received the keys to your new apartment in Marseille. The developer hands you a thick file: technical specifications, warranty certificate, but no handover report. You sign anyway, caught up in the moment. Big mistake. In a significant share of VEFA (off-plan purchase) handovers I assess on the French Riviera, the absence of a handover report hides unlisted defects, sometimes serious ones.
What you see — and what it’s really hiding

On handover day, you compare the VEFA floor plan with the apartment: the measurements seem right, the finishes look clean. But you can’t see what’s behind the walls or under the tiling. Without a handover report, there’s no joint record of any reservations.
Here’s what nobody tells you: months later, the developer can claim that you accepted the property as-is. One buyer signed without a handover report; six months later, cracks appeared on the façade. The developer refused any repairs, arguing the handover was implied. I had to measure the flatness deviation with a Leica TS total station: 12 mm over 2 m — double the tolerance allowed under the NF DTU 20.1 standard. The court ruled in the buyer’s favour, but only after two years of proceedings.
The numbers that change everything: surface area and compliance gaps
Take a real case in Marseille. The VEFA plan states a surface area of 65.20 m². You measure it with a laser distance meter: 64.10 m². That’s a 1.10 m² shortfall. Applying the rule under Article L261-11 of the French Construction and Housing Code (paragraph 2: the surface area must be accurate within 5%), the tolerance threshold is 65.20 × 0.05 = 3.26 m². The shortfall falls within tolerance. But if the gap were 4 m² (6.1%), you could claim a proportional price reduction. The formula: reduction = (total price / stated surface area) × shortfall. For a property priced at €390,000: (390,000 / 65.20) × 4 = €23,926. What this means in practice: without a handover report, you have no official record of the surface area — and therefore no legal basis to claim that reduction.
What happens if you do nothing
Six months go by. A leak appears under the kitchen sink. The developer tells you: « Handover is deemed complete, it’s now your responsibility. » Except without a handover report, handover isn’t legally established. Article 1792-6 of the French Civil Code (paragraph 3) states that handover is the act by which the client accepts the work, with or without reservations. In the absence of a handover report, you can still raise reservations within a reasonable period (case law: 30 days). But after 2 years, visible defects become covered as accepted. Estimated repair cost for an untreated leak: €1,500 to €4,000 depending on the extent of the damage.
Frankly, it’s not uncommon to see cases in Marseille where the absence of a handover report led to disputes lasting several years, with expert assessment fees of €5,000 to €10,000 — not to mention the property’s loss of value on the French Riviera’s tight real estate market.
Remedies and guarantees: what you’re entitled to demand
You’re protected by the one-year defects liability guarantee (Article L261-11 of the French Construction and Housing Code, paragraph 4): for one year, the developer must repair all reported defects. Even without a handover report, send a registered letter with acknowledgment of receipt listing your reservations within 30 days of receiving the keys. If the developer refuses, bring in an independent expert for a joint inspection report. If that fails, take the matter to the Marseille judicial court. Article 1792-6 of the French Civil Code (paragraph 5) lets you demand repairs for any damage compromising the structure’s soundness or making the property unfit for its intended use. Don’t delay: the limitation period is 2 years for visible defects, 10 years for hidden defects.
